Item 1.04 Mine Safety
On June 6, 2012, Vulcan Materials Company (the “Company”) received an imminent danger order issued by the Mine Safety and Health Administration (“MSHA”) under section 107(a) of the Federal Mine Safety and Health Act of 1977 at our Royal Stone Quarry located in Richmond, Virginia. The employee, a plant greaser, was observed by the MSHA Inspector reaching over the bend pulley guard of the gravity take-up system and the top rail inside the box frame of C-2 conveyor at the Primary Plant to remove a grease hose with the conveyor running. According to the Order, the employee put himself at danger of being entangled in the conveyor between the top rollers and the conveyor belt. The employee was not injured.
