The L1A visa is designed for executives and managers employed by multinational companies who are transferred from an overseas office to a related entity in the United States. While the visa itself is temporary, immigration attorneys note that it can serve as a strategic pathway toward obtaining a U.S. green card.

According to information published by Global Immigration Partners PLLC, many L1A visa holders qualify for permanent residency through the EB-1C classification for multinational managers and executives. This category is specifically intended for senior-level professionals who have worked in a managerial or executive role abroad and are continuing in a leadership position with the same employer in the United States.

“One of the key advantages of the EB-1C pathway is that it does not require PERM labour certification, which is typically required in many other employment-based green card processes,” said Co-managing Partner Alexander Jovy of Global Immigration Partners PLLC. “By eliminating this step, the process can often be more streamlined for qualified multinational executives and managers.”

To qualify for EB-1C classification, applicants generally must have worked for a qualifying foreign affiliate, parent, subsidiary, or branch of the U.S. employer for at least one continuous year within the past three years in a managerial or executive capacity. The U.S. employer must then sponsor the employee for permanent residency by filing Form I-140, Immigrant Petition for Alien Worker.

Once a visa number becomes available, eligible applicants in the United States may file Form I-485, Application to Register Permanent Residence or Adjust Status, allowing them to complete the green card process without leaving the country.

While processing times vary depending on visa availability and case complexity, the transition from an L1A visa to a green card through EB-1C can often take approximately 18 to 30 months for many applicants.
